Cause for a refund?

I'm not sure if this is cause for a refund part or in full, exchange or nothing.
The other day I bought a driver from bluearan great quick service no complaints.

However the thiele parameters for the driver are different to the ones published on the manufactures site. For the exact same product. Ive asked for a clarification from bluearan as I know obviously specs can change.
But if the specs (thiele parameters) published on there site were indeed wrong, then as I based my purchase on there info, and made the cab tuning based on there specs, then would I have grounds for an exchange, refund or part refund or nothing at all for the driver?

In what way are they different? Drivers' performance does alter when broken in compared to brand spanking new, and these changes are permanent: bass response can go down a few more Hertz, sensitivity up a bit, etc, (the suspension frees up). Fresh out of the box is not what you end up with unless you never turn up the wick.

The thiele specs on blue aran for that driver are different to what the manufacture lists.
I based my cab tuning on those specs listed on bluearan which according to the manufacture are wrong.
