And where do you think they got the name The Smiths from in the first place?

To be accurate.... ....they were paid, the disagreement was over how the performance royalties etc were to be divided up. Moz+Marr couldn't prove that Rourke+Joyce had been informed of and had agreed to the 40–40–10–10 split that had been operating since day one. Since Rourke had made a final settlement before the trial and couldn't exploit the decision made in Joyce's favour I guess that means performance royalties are now being split 32½–32½–10–25? At any rate, Joyce and Rourke were always getting a share of the performance profits. ....It was Joyce's own lawyer who used that description of Moz's attitude towards Rourke and Joyce I'm sure if The Smiths reformed, the absence of Joyce trotting along behind the drums would make 0% difference, either to the massive sales or the quality of the performances. And I'm sure if Rourke was offered 10% of the massive mountain of money sitting waiting for that moment, he would be extremely happy. I was just writing from memory having read his autobiography some years back. It’s still sad that bands sully their reputation by squabbling in court and ripping each other off, particularly if they align themselves with left wing anti capitalist rhetoric. Speaking of which how did Morrisey end up politically so misaligned? The full court transcript is here if anyone is interested https://www.bailii.org/ew/cases/EWCA/Civ/1998/1711.html
Fozza
I love the judge's description of Morrissey in the trial - "devious, truculent and unreliable where his own interests were at stake". Morrissey wrote a bitchy song called "Sorrow Will Come in the End" about the whole affair. It's excruciating. Legalized theft Leaves me bereft I get it straight in the neck (Somehow expecting no less) A court of justice With no use for truth Lawyer...liar Lawyer...liar You pleaded and squealed And you think you've won But sorrow will come To you in the end And as sure as my words are pure I praise the day that brings you pain Q.C.'s obsessed with sleaze Frantic for fame They're all on the game They just use a different name You lied And you were believed By a J.P. senile and vile You pleaded and squealed And you think you've won But sorrow will come To you in the end And as sure as my words are pure I praise the day that brings you pain So don't close your eyes Don't close your eyes A man who slits throats Has time on his hands And I'm gonna get you So don't close your eyes Don't ever close your eyes You think you've won Oh no Edited October 5, 2021 by Fozza

Probably written in the garden of Clark Gables old house in the LA sunshine sipping a nice little number from Nappa. The slightly awkward and pretentious lad who but for a chance encounter would probably have been a librarian in a small flat in Salford and all he can come up with is bitterness and less forgivable very average tunes.
