Does that mean that Fenders are infringing on Rickenbacker's trademark? It seems a rather waving-hands-in-the-air-vaguely sort of definition of what is infringing and what isn't.

John Birch was never a "one-man band" but he was never far from it. He was making Rick copies up until the very end - and there was still one left at John Carling's the last I heard. It begs the question that since JB guiatrs was so tiny why didn't Rickenbacker hit JB with some kind of injunction, or even go so far as to sue him.
Might be worth having a word with John Carling; who was John Birch last business partner up to his death, about how they avoided Rick's wrath?

I did that once with an Antoria EB3, I wondered how it would look & sounds as all black with two Musicman pups in it. It was still in bits months alter & went in the bin when I moved house.

Even as I type there are currently four, count 'em FOUR Rick copies on Ebay. That's taking the piss out of Ash's John Birch. I can only think it's because Ash's is a better build quality than a real Rick And John Hall knows it.
Though as has been said on here, the same could maybe be said about the Ibanez one.

I think that RIC could be challenged on attempting to protect trademark where (i) the word "Rickenbacker" isn't used, thereby there being no apparent attempt to confuse the origin of the item and (ii) the article is secondhand. [url="http://law.slu.edu/library/research/WilsonFirstSaleDoctrine.pdf"]See this article on first-sale doctrine.[/url] I think ash could challenge Ebay over the John Birch he's trying to sell on these grounds.

He can't challenge ebay, because they are entitled to do whatever they like with their own website. Ebay could challenge RIC, but they won't, because it is a tiny amount of revenue they are missing out on.

Ebay are saying that he's in breach of their T&Cs because of trademark infringement. If he's not, then there is no case for them to remove the listing.

That is not in dispute. The fact remains they can remove whatever they want, whenever they want, from their site. They are not obliged to give a reason.

Even if you proved the point in court, that it was not in breach of their rules, they'd still not have to publish your advert on their site.
