According to another article referenced in the above, he recreated the photograph 5 years ago and allegedly suggested to the photographer that he, Elden, should be naked. 

 

"I said to the photographer, 'Let's do it naked.' But he thought that would be weird, so I wore my swim shorts," Spencer told the New York Post.

Perhaps he previously wasn't too concerned about the pic, however more recently whenever he'd meet a young lady and start dating she'd have no idea of his former fame, but then when they were about to get intimate he'd strip off and she'd take one look and say "hey - your winky looks just like the kid's on the Nevermind cover"

He's capitalised on his image on the album many times.
Traumatised? Yeah right....
He stands zero chance of winning.
He may even lose a lot of money.

Whatever happened to the normal concept of a one-off fee for a job?

If his parents put him forward for this, he should sue THEM to get that fee.
The members of Nirvana don't have any case to answer.
I bet a model release form was signed by someone at the time. They were paid $200 apparently.

Nevermind's 30th anniversary is coming up next month. Lots of PR and media buzz to be expected. Could this have something to do with the guy deciding to sue the remaining band members, Courtney Love and the record labels (15 defendants in total, suing each for at least $150,000) now or could this just be a coincidence? Well, never mind 😉

Apparently when he was 16 he said to the camera guy should he do it naked, then decided it was not a good idea.... hopefully this will get laughed out of court... but then again. If you google him 'Spencer Elden' you discover he is an artist.... a pretty bad one from the looks of it and most likely skint, hence the lawsuit.

I wonder if the relatives of David are contemplating sueing Michelangelo for the pain and suffering of portraying him with such small tackle. 

He needs to sue the band to pay for the tattoo removal at the urging of his very expensive psychologist.

Here are the times he’s recreated the image which he’s now “traumatised” by - not underestimating the “trauma” of having “Nevermind” being tattooed across his chest.

And the “hey, I’m the guy who was the baby on the nevermind cover” pickup line to get laid and the subsequent “damage” of being dumped because his fame wasn’t much of an earner…

Just needs to go and trap his head in a door somewhere.
