I think the key thing about keeping the goods is whether the seller is willing to negotiate. eBay prefer it if you try to sort it out between yourselves and I've found that most people are willing to come to an agreement provided the buyer covers return carriage. In my case, the seller refused to cooperate at all, so eBay provided the refund & I also kept the bass.

I think this scenario is a last resort for eBay & so isn't the potential win/win situation it probably sounds like - most sellers have been reasonable in my experience. I guess it must be more cost effective to eBay to let you keep disputed items rather than having to set up a warehouse to process dodgy stuff that they didn't sell in the first place!

That article as about stopping negative feedback for buyers. Again I might be missing the point, but this would be negative feedback for a *seller* which is allowed,surely?

This was one of my reasons for buying in the first place. However all the feedback is for smaller items like books and DVDs and suddenly in the last week they seem to be the bass specialist (6 instruments sold or for sale). It's a fair amount of 100%'s so I readily accept this as genuine BUT the fact remains that I've been sent a fake (knowingly or otherwise) and my £25 for next day specialist Royal Mail delivery got me a Royal Mail 48hr stamped box. In terms of why we've gone from an honest seller dealing in small items a year ago to what I have now, I can only speculate. I don't want this current situation and nor did I invite it.

I actually meant, why have *you* not added negative feedback which might warn others?

I think this business of the buyer paying for return carriage is unreasonable.
I have bought an item of e bay that is not as described, doesnt work, and is uneconomic to repair. Im happy to return it to the seller but why should I be out of pocket for an item i bought in good faith as in good working order?

You shouldn't but the world doesn't go around like that. You are mostly, now, in the business of minimising your losses. It's like car insurance. You still don't want to have an accident as you don't get paid for all the grief, time and lost value now your car is damaged-repaired.

D'oh! Sorry. I was working lates last night so I tend to be a zombie the next morning. I plan to the second that this is resolved.

Also, I phoned EBay this morining (having now received a message from the seller sounding genuine "send it back for a full refund" etc). I phoned EBay and they say 1) refund still stands, 2) Don't communicate with the seller, 3) Don't return item - it could be used again to rip someone off & 4) They are sorry I've had this experience.

I felt it was the ethical thing to mention that seller was now trying to be reasonable (although in the back of my mind I suspect this is because EBay have started to make things difficult - so it may not be genuine). If EBay had said return it, I would have been guided by them OR if they had said go with trying to now communicate I would. They said neither.

I don't know what Ebay are planning but there's no way you are keeping the bass and the money. They call that theft or something :-) You'd need a court order for that sort of thing.

I'm afraid that's not law, just ebay policy. There's no legislation to say you may keep counterfeit goods if you've already had a refund AFAIK. Maybe ebay are not chasing the seller for the money in which case no problem as the property would be deemed to have had legitimate transfer of ownership. I think.

I can imagine the call to the police :) "I'm a bit worried an ebay seller might come round to my house to get his bass back and extract a few of my teeth while he's at it, would you kindly post a watch outside my front door for a few weeks?" :rolleyes:

It's predominately a civil matter not a Police matter & I don't think there is any immediate threat here at this time. The seller may start sending funny messages but I don't want to speculate.

Also it's not a theft if I keep the money / item as the legal defination of theft includes "dishonest appropriation" - there is no dishonesty if you have been told by EBay that you are within your rights to keep the item. I wonder if perhaps EBay won't be chasing the seller? I think where this goes wrong is that I've had pretty poor communication from EBay. If all of there actions were explained I'd probably be a little more relaxed with the situation.

Sorry - I didn't mean that literally. If you are very charitable and assume the seller didn't know. He now has no bass and no money. He's probably calling his lawyer... etc etc

I will always prefer to deal with a seller myself, I don't think I would trust ebay to be anywhere near as diplomatic as I can be (hold the jokes :).

I would rather an equitable outcome with no hard feelings. Although, I had a problem with one business seller on ebay who was a complete c**t over a few quid, he sent me the wrong item and when I complained he sent me abusive messages, I wasn't alone either. I sent it back and paid the postage. He never refunded me. I won the paypal dispute, he went out of business. I never got all my money back.

EBay have now withdrawn the seller's account. Silddx - I too think I am pretty diplomatic as a rule and I think large companies can have blanket policies that sometimes don't always apply. From my point of view I've entered into a transaction seemingly honestly and been stiffed over. Now I am simply following instructions. I don't especially want a civil court case but they are welcome to try. I just wish I'd never bought the thing! I assure you all it's sitting in the box untouched and I'm getting no pleasure from any of this.

I really do sympathise with you, I wouldn't want that bass tbh. I think, all things being well, ie. refunded, seller ok with the situation, etc., I would probably give it to a local school.
