Ebay Rip -off revenge post

Looks like someone is sending out a warning.
74 Jazz bass for £3,993 on ebay but it's actually a warning to any potential purchasers of stuff from 2-Gnome-Attic

This guy has been sticking up loads of auctions up for this bass but without actually naming the seller, presumably in an attempt to coax a refund out him. There's a thread or two about his previous ads about somewhere.

Looks like he's given up on getting his money back though.

This has been going on for many months now - the seller is the biggest vintage guitar dealer on eBay - '[b]Tune O Matic[/b]' ('2-Gnome-Attic' - get it?)

He does actually have a very good reputation, his stuff is always good - he's sold some absolutely incredible vintage basses - but always for v.high BIN prices. And he sells a lot of rare parts - again for very high BIN prices.
But something obviously went very wrong here...!!!
And the buyer just won't let it lie...

I had a similar USA bass experience experience with a far stronger case. He'll get nowehere through law (I sought advice) and I doubt through coersion. More importantly, I doubt he's doing his mental health a whole lot of good dragging this out for the six months or so he's been pursuing it. He's stil got a 74 Jazz, he should let it go.

Isn't this the problem with a lot of ebay purchases in that you don't have the 'try before you buy' option. I have a few old Fender basses (60's/70's) which I bought years ago from, wait for it...... ordinary, good old fashioned music shops. These shops used to have a selection of both new and old instruments for sale. You examined, tried and then you made a decision to purchase or not in the shop. The sad thing is that, with the exception of a few specialist shops that seem to charge the earth for anything that's 'old', you can't do this anymore. I have never bought off ebay and this poor bloke from Burton with his '74 Jazz makes me think that I probably never will.

I must be getting old.........

I agree with you. I wouldn't have spent that sort of money on E-bay and especially not buying from the USA. For me half of the pleasure of buying a new bass is going to the shop and spending a couple of hours trying out different ones. For that kind of money he didn't need to go to the USA to get ripped off. He could have done that in Denmark Street

I seem to remember this Tune-O-matic guy was the subject of a thread on Bassworld. If not Bassworld then I've seen him discussed somewhere. It could have been Talkbass. He does sell a lot of good stuff but judging by the experience of isinglass he knowingly sells some lemons too. His method of dealing with any kind of complaint or criticism is to be incredibly aggressive and bury the person complaining under a torrent of personal abuse. I've read some of his responses to questions about his listings and the way he speaks to people is beyond belief. He is also apparently not slow to threaten legal action.

I wouldn't buy off him under any circumstances.

In my experience, that is not an unusual response from a USA dealer. You only have to look at some of the aggressive and often threatening text in bass listings on ebay.com to realise that, even if you lived 5 minutes form the guy selling the immaculate '57 Precision for $500, you'd still rather pay for a courier. You certainly wouldn't complain if a Wesley turned up either :)

This chap is wasting his time and making himself look silly.

I thought he was talking about a seller with the name 2 gnomes in the attic. I have seen tune-o-matic's auctions in the past and never made the connection. If he can't name the seller properly he might as well stage a sit-in in his own bathroom for all the difference its going to make.

I've had quite a few conversations with this chap, and know the circumstances pretty well.

He's not obsessive - far from it. He's just been completely ripped off and he's a little bit sore about it. By repeatedly placing these auctions he's just making sure that T-o-M is constantly reminded that it hasn't been resolved. They're not aimed at 'Joe Public' so to speak.

If that's the case then perhaps there's some purpose to his continued action. However, from my brief venture into the murky world of legal action in the USA, I doubt he'll get anywhere through law. Furthermore, as he's clearly aware, he's now probably close enough to the mark for them to sue him for defamation or whatever is the USA equivalent. I could recount several cases in my domain where the person in the wrong has succesfully sued the person in the right in similar circumstances to those above. USA is not just a diferent legal system to the UK but a different culture. If T-O-M were intending to make some form of reparation 'gesture' to stop the possible damage to their business, I would have thought they would have done so long ago.
My instinct is he'll get nothing but a large ebay bill. Sad, but that's life. As my girlfriend said of my previous situation, if you can afford to spend £1000 on a bass guitar, you can afford to lose it.

There are deffinitely more important things in life, that's a very good point. However, if I personally got ripped off for £1000 i'd be using a lot of my free time to get it back, as I can't afford to loose it. There's no need to get upset about it, but maybe he's not getting upset?

I don't really know much about the case, but I read about your generosity with that broken flea bass, and I was quite shocked to be honest. It's very obvious that you have a LOT more money than me. I'm a generous and laid back person, I hate money, and I never worry about it, but I don't have enough of it to have the same attitude as you, and obviously, this guy on ebay is in the same position.

Thanks for the above, but it was not generosity and I certainly do not have a lot of money (my bank manager would p*ss himself laughing of he saw your post above, really). It was the right thing to do and I had to sell my Shergold Marathon and my USA Jazz to raise the cash to do it. These things happen. As I said, there's more important things. I didn't lose in the end, I'll still have a great Flea Bass when I get it back from Martin Simms. I understand how the guy above feels, I just think there comes a time to let it go before it backfires on him. I was told in no uncertain terms that taking someone in the USA to law from the UK would be extremely expensive and - this is key - even if I won I would have a serious problem enforcing any judgement. That is, I wouldn't get my money. I would in fact be be out of pocket. Now, even more critical, my legal advisor said the following "his brief knows that you're having this conversation with me, so he knows that you know what I've just told you. That means, his brief is saying to him 'sit back and relax because this guy can't touch you without only getting a 10% return on his money. Unless he's an idiot, he won't do that". That's why I'm getting my bass refinished and have let it go.

I didn't realise you had to sell gear for that! That's harsh. I'm sure you're right about the legal situation, and like I say, I don't really know about it. All I read is "If you can afford to spend £1000 on a bass, you can afford to loose it", which I don't think is true, or, it's not true for me (and I like to argue!). To be fair I did have a couple of guitars nicked from my house and I wasn't really bothered or upset, or worrying about the money. If they were selling them nicked on Ebay though, i'd probably try to do something. I got my fender acoustic 4 string back, which is cool.

Agreed. I didn't mean to be patronising about money. I just think life's too short to think of it as the only thing. The guy's main gripe is that, although he's got a lovely '74 bass, it cost him more money than it should. Hey, looking at Fender prices at the moment that's gonna be true for a lot of us soon!
